According to Tony Windsor MP, federal member for New England, the election of the Rudd government may be a good thing for health
as it will likely end the "blame game ".

Without the "blame game" at her disposal - How will Reba Meagher cover up her mistakes as NSW Health Minister ?

The ball's now firmly in Reba's court. Hopefully she won't fall asleep at the wheel again, lest health in NSW run off the road again and
come to a sudden halt at the base of a tree.

TRUTH  STRANGER  THAN  FICTION

















Jerid Sturman-Camyn, a 20 year old university student { biography online }.,died about 11.30pm Saturday 24 November 2007 north of
Spokane, Washington State, USA.

He had been dragged behind a truck, at the end of a rope.

Police were told by the 17 year old driver of the truck  that he was fleeing from a man wielding an axe. The 17 year old was unaware
there was a rope with a man attached to the truck he was driving.

Earlier in the evening it is alleged, Jerid Sturman-Camyn had threatened a group of campers with an axe, It is alleged that 45 year old
Wendell C. Sinn Jr, told the 17 year old to sit  in the truck, ready to flee the scene should matters "get out of hand". It is then alleged
that Sinn Jr tied a rope to the deceased, attached the rope to the truck occupied by the 17 year old, and then told the 17 year old to
drive away from the campsite in order to avoid Sturman-Camyn who was out of control.

Sinn Jr has been charged with murder. He was allowed bail on a $100,000 bond and is not considered a flight risk.

DOES FRED NILE BELIEVE IN FAERIES TOO  ???

Rev Fred Nile has told us in relation to the extra $43,030 per year he is now receiving courtesy
of the gazetting by Morris Iemma of the
Parliamentary Remuneration Amendment (Miscellaneous Offices)
Regulation 2007
. (GG No 169 of 16.11.2007, p 8511) :
You (f)ail to understand the payments are not made by the Premier but by the Independent
Parliamentary Remuneration Commission.

Leaving aside the fact there is no such thing as the Parliamentary Remuneration Commission
(we are sure he is attempting to refer to the Parliamentary Remuneration Tribunal), as we
pointed out previously [
HERE ], the Parliamentary Remuneration Tribunal has nothing to do with
what offices receive extra salary and expense allowance or the amount of that extra salary and
allowance, and it is the Premier, as the minister responsible for administration of the
Parliamentary Remuneration Act 1989, who sets such things.

Perhaps Fred Nile has been sucked in by the spin of Premier Iemma's media advisor Alison Hill,
in respect of whom it has been reported :
Alison Hill, said the price rises were made on the "advice of the Parliamentary Remuneration
Tribunal"

As we said previously, the Tribunal has no jurisdiction in respect of Schedule 1 (the Schedule which
sets Fred Nile's pay rate) and it would be incredible that the Tribunal would be engaging in an
exercise of "advising" in respect of a matter it had no jurisdiction in respect of.

The Tribunal, itself in its annual report of 13 July 2006 was at pains to point out that it had no
jurisdiction in relation to office-holders extra pay or expense allowance.

SO DOES  FRED  NILE  BELIEVE  IN  FAERIES  TOO  ???

WELL  TECHNICALLY  SPEAKING ......

Technically speaking we guess it wasn't the Premier who "signed" or "made" the Parliamentary Remuneration Amendment
(Miscellaneous Offices) Regulation 2007,
but the Governor.

However, to say the Governor was responsible for awarding Rev Fred Nile the extra $43,030 would be the epitome of the 'blame-
game'.

It is possible to say that the regulation, which changed Schedule 1 of the Act to provide Fred Nile with the "extras" was made by the
Governor,because she is the only person able to do so. Section 21 of the Act says:
The Governor may make regulations, not inconsistent with this Act, for or with respect to any matter that by this Act is required or
permitted to be prescribed or that is necessary or convenient to be prescribed for carrying out or giving effect to this Act.

Yet it is well known the Governor only does things as advised by Ministers of the executive government. She must do as they request,
unless the act is tainted by illegality, So it really is a "fiction" or a "faerie tale" to suggest she is responsible for the extra dough in
Fred Nile's pocket - paid of course out of the funds of the NSW community.

We just mention this because so far Fred Nile has blamed the following people for making the position of Assistant President, one
that carries extra salary and expense allowance (and the amounts)  :
  • the department (according to Andrew Clennell)
  • the Parliament (in an email to Alex)
  • the Independent Parliamentary Remuneration Commission (sic) (in an email to Alex).

We just mention the Governor, because it is possible she will be the next in line for the blame.

When will Fred Nile accept reality - the reality that the decision to award the office of Assistant President "extras" was made by the
Premier and the amount of those "extras" was determined by the Premier.

Further, when will Fred Nile accept the reality that the Premier either had no advice from the Parliamentary Remuneration Tribunal
about those things, or if he did, the Tribunal was acting beyond it's statutory function.

Perhaps for Fred Nile it's better to inhabit 'faerie land' than to live in reality.

In that 'faerie land', apparently the Premier of NSW does not accept responsibility for his actions.
PARLIAMENTARY REMUNERATION TRIBUNAL - NON-EXISTENT FOR A TIME

By section 8 of the Parliamentary Remuneration Act 1989 (NSW) :

(1)  For the purposes of this Act, there is established a Tribunal to be known as the Parliamentary Remuneration Tribunal.
(2)  Schedule 2 has effect with respect to the Tribunal.

By Clause 1 of Schedule 2 of the Act :

1   Appointment of person to constitute Tribunal
(1)  The Tribunal is to consist of a judicial member or retired judicial member of the Industrial Relations Commission
appointed by the President on a part-time basis.
(2)  Subject to this Act, the person appointed holds office as the Tribunal for such period, not exceeding 3 years, as is
specified in the instrument of appointment of the Tribunal and is eligible for re-appointment
.

It would be fair enough to say that the Tribunal consists of the appointed judicial member. It would also be fair enough to say if there
is no appointed judicial member, there is no Tribunal.

On 5 August 2004 , the President of the Industrial Relations Commission signed an Instrument of Appointment appointing Justice
Boland as the Parliamentary Remuneration Tribunal for a term of office commencing on 1 September 2004 and ending on
31
August 2007 .
That was published in the Government Gazette on 22 October 2004 ( No 166, Week 43/2004,  p. 8138) [ online ]

On 14 November 2007, the President of the Industrial Relations Commission signed an Instrument of Appointment appointing Justice
Boland as the Parliamentary Remuneration Tribunal for a period of 3 years commencing on
14 November 2007 and ending on 14
November 2010. That was published in the Government Gazette on 23 November 2007 ( No 172 , Week 47/2007, p.8595 ) [

THUS you will see that there is a gap between 1 September 2007 and 13 November 2007, when there was no no-one holding an
appointment as the Parliamentary Remuneration Tribunal. It is fair to say the Parliamentary Remuneration Tribunal did not exist
between those dates.

The Regulation which gave Fred Nile and others their handsome rewards was published in the Government Gazette on 16 November
2007.

According to Alison Hill that was done with the
advice of the Tribunal. According to Fred Nile it was done by the Independent
Parliamentary Remuneration Commission
(sic).

Must say it is strange how a non-existent body is able to give advice or do things.

BUT presumably everything is possible in this "faerie land" we live in.

MONEY  DOESN'T  BUY  LOVE

Another article at the Sydney Morning Herald disloses how business is done in NSW.

Donations from the hotel industry and the Property Council are detailed.

Records at the commission also show that one week after the Premier, Morris Iemma, ruled that 2 per
cent of the state's petrol had to be ethanol-blended, the company with the most to gain from the
announcement, Manildra, gave $15,000 to NSW Labor.

ELECTION  FUNDING INQUIRY FINALLY  UP  AND RUNNING

The Legislative Council - Electoral and Political Party Funding (Inquiry) is finally up and running.

The Committee is chaired by Fred Nile MLC.

On 19 November 2007 the committee finally called for public submissions.

Submissions
close on 15 February 2008 and the committee is expected to report by 26 June 2008.

PREMIER  IEMMA's NEW  RULES  OF  GOVERNMENT

Mr THOMAS GEORGE :..... There seems to be a new edict that when members of Parliament make representations on behalf of
constituents the Government replies directly to the constituent and sends the member a copy of the reply. That is not
courtesy. Ministers visit areas and do not advise the local member of their proposed visit. That is the arrogance we have
come to know from this Government. ......
In future would you please send any correspondence from the Department of Education and Training directly to me and I will
forward it on to the constituent?.......(L)et me tell you that the constituents do not appreciate it either. My constituents rang
me and highlighted their concerns about receiving a direct reply when they had contacted me in the first place. I think it is
respected around here that
no one tries harder than me to stick to some sort of code of ethics but when Ministers come to
your electorate and write directly back to your constituents bypassing the local member it is not appreciated.
